Sexual assault is a traumatic experience for anyone to face. While a criminal trial may result in criminal penalties, such as jail time and fines, this does not occur in every case. In criminal trials, prosecutors bring the case against your assaulter on behalf of the State of Texas. You may have given statements to police and prosecutors about the sexual assault you endured or even called as a witness for your assaulter’s trial. In the end, your assaulter may or may not have been convicted in the criminal case. No matter how the case may have turned out, this is not your only avenue of justice against your assaulter. 
 

Attorneys in criminal trials have to prove that your assaulter committed the crime beyond a reasonable doubt. This is a high burden to meet. However, in a civil trial, there is the lesser standard--the preponderance of the evidence. This simply means that it is more likely than not that your assaulter committed the sexual assault. Through a civil suit, a victim may be able to obtain compensation from their assaulter or other parties to cover expenses such as medical costs, psychological treatment, emotional therapy, and pain and suffering.
